1. Acceptance of Terms

By accessing or using Toco Pet ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms and conditions, you must not access or use the Platform.

These Terms apply to all visitors, users, sellers, and buyers who access or use the Platform. We reserve the right to update these Terms at any time, and continued use of the Platform constitutes acceptance of any changes.

2. Description of Services

Toco Pet is an online marketplace that connects pet buyers with pet sellers and breeders. The Platform allows users to:

• Browse pet listings and discover pets available for sale or adoption
• Create accounts and manage profiles
• List pets for sale or adoption (sellers)
• Communicate with sellers and buyers
• Complete transactions through our integrated payment system

Toco Pet acts as an intermediary platform and is not directly involved in the actual transaction between buyers and sellers. We do not transfer legal ownership of pets from sellers to buyers.

3. User Accounts

Registration

To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary.

Account Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any conduct that we deem harmful to the Platform or its users.

4. Seller Obligations

If you list pets for sale or adoption on Toco Pet, you agree to:

• Provide accurate and truthful information about each pet, including health status, breed, age, and medical history
• Ensure all pets listed are legally owned by you and that you have the right to sell or rehome them
• Comply with all applicable laws and regulations regarding pet sales and animal welfare
• Respond to buyer inquiries in a timely and professional manner
• Honor all commitments made to buyers, including agreed-upon prices and delivery arrangements
• Maintain high standards of animal care and welfare

5. Buyer Obligations

If you purchase or adopt a pet through Toco Pet, you agree to:

• Provide accurate information for transaction processing and delivery
• Complete payment in accordance with the agreed terms
• Communicate respectfully with sellers
• Take responsibility for the care and welfare of any pet you acquire
• Comply with all applicable laws regarding pet ownership in your jurisdiction

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Listing pets that are not legally owned or that cannot be legally sold
• Misrepresenting the breed, age, health, or any other characteristic of a pet
• Engaging in fraudulent transactions or chargeback abuse
• Harassing, threatening, or abusing other users
• Attempting to circumvent our payment system or fee structure
• Using the Platform for any illegal purpose or in violation of any local, state, national, or international law
• Uploading malicious code, viruses, or any content that could harm the Platform or its users

7. Payments and Fees

All payments on Toco Pet are processed through Razorpay, our third-party payment processor. By using the Platform, you agree to:

• Pay all applicable fees as described at the time of transaction
• Provide valid payment information for transactions
• Authorize Razorpay to process payments on our behalf

We reserve the right to change our fee structure at any time. Any changes will be communicated to users in advance.

8. Intellectual Property

The Platform and its original content, features, and functionality are owned by Toco Pet and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written consent.

9. Limitation of Liability

Toco Pet and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses.

Toco Pet is a marketplace platform and is not responsible for the actual transaction between buyers and sellers. We do not guarantee the accuracy of listings, the health of pets, or the conduct of users.

10. Indemnification

You agree to indemnify, defend, and hold harmless Toco Pet and its affiliates from any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of another party.

11. Dispute Resolution

Any disputes arising out of or relating to these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the laws of India. You agree to first attempt to resolve any dispute informally by contacting us.

If a dispute cannot be resolved informally, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The place of arbitration shall be India, and the language shall be English.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
